In the interest of time and order, presentations from the public are limited to three (3) minutes per person, and the total time for items shall not exceed twenty (20) minutes. An individual speaker's allotted time may not be increased by a donation of time from members of the public in attendance. If you wish to speak under Public Comments, please complete a Public Comment card and turn it in to the Superintendent's Assistant. The Board requests complaints or charges against an employee be held in Closed Session. Please note that Government Code Section 54954.2(a) limits the ability of Board Members to respond to public comments.   8. Consent Agenda - Consolidated Motion The purpose of the Consent Agenda (Consolidated Motion) is to expedite action on routine agenda items.     10. 2015-2016 Annual AuditExplanatory Statement: (Finance/Facilities)The firm of Vavrinek, Trine, Day & Co. has completed the District's Annual Audit for the 2015-2016 fiscal year. Bound copies of the audit will be distributed to the Board at the meeting. An electronic copy is attached as backup to this item. As reported in the summary on page 94, there were no material weaknesses or reporting conditions identified during the audit. A representative from Vavrinek, Trine, Day & Co. will present the audit and be available to answer questions. Attachment: 15-16 Annual AuditRecommended Action:Accept the 2015-2016 Annual Audit.

    11. CUSD Foundation Bylaws Article IV Amendment Explanatory Statement: (Policy and Judicial Review) The Ceres Unified School District Foundation is amending Article IV of its bylaws with regard to the Section 1- Number/Tenure of office of the Board of Directors. This amendment will add two alternate positions to the number of directors on the board of the CUSD Foundation.   Attachment: Article IV Amendment Feb 2017Recommended Action: Approve the amended language of Article IV, Section I of the CUSD Foundation bylaws.

    12. Resolution Regarding Clarification of the District's Role in Educating All StudentsExplanatory Statement: (Student Learning and Achievement)Given a heightened dialogue both in our community and nationally regarding the disposition of undocumented immigrants, the attached resolution clarifies the District's role in educating all students, regardless of immigration status. The attached fact sheet from the Association of California School Administrators provides additional information concerning student, staff and parent rights.

    13. Resolution Regarding Board Remuneration for Allowed AbsenceExplanatory Statement: (Finance/Facilities) Board Bylaw 9250 and Education Code 35120 establish the following with regard to Board member remuneration for attendance at regular meetings: Any member who does not attend all Board meetings during the month is eligible to receive only a percentage of the monthly compensation equal to the percentage of meetings he or she attended, unless otherwise authorized by the Board in accordance with law. A member may be compensated for meetings he or she missed when the Board, by resolution, finds that the Board member was performing designated services for the district at the time of the meeting or was absent because of illness, jury duty, or a hardship deemed acceptable by the Board.

      Trustee Betty Davis was not present at the regular meeting of January 12, 2017, due to bereavement. The attached resolution provides for Mrs. Davis' full compensation for the month of January as allowable by law.     14. Election of Representative to 2017 CSBA Delegate Assembly Explanatory Statement: (Community Relations and Advocacy) Annually the Board of Trustees may cast a ballot for representatives from Stanislaus County to the California School Boards Association (CSBA) Delegate Assembly, Subregion 8-C. The Board as a whole votes for up to the number of vacancies in the subregion, as indicated on the ballot. For 2017, there are two vacancies. Attached is information sent by CSBA on the two candidates seeking election to the Delegate Assembly. In addition, attached is information received from an incumbent Delegate requesting to be added to the ballot as a write-in candidate.

      The attached ballot must be signed by the Superintendent or Board Clerk and postmarked on or before Wednesday, March 15, 2017. Election results and the names of all Delegates will be available on CSBA's Website no later than Monday, April 3, 2017. All re-elected and newly elected Delegates will serve two-year terms from April 1, 2017-March 31, 2019.

October 2016 Board Policy RevisionsExplanatory Statement: (Policy and Judicial Review) In the process of maintaining and updating our Board Policies and Administrative Regulations to comply with current law and the California School Boards Association (CSBA) recommendations, a draft copy of the October 2016 Updates and Proposed Revisions was made available for Board Member review and first reading at the December 8, 2016 meeting, with clean copies of the proposed revisions presented for a second reading at the January 12, 2017 meeting. The proposed revisions are being presented for action at this meeting.

      If you have need to refer to the present CUSD Board Policy in reviewing this material, Board Members can access the current policies through the CSBA Online service. Others may call the school office at (209) 556-1500, to request access to the policy.
